ROLE AND LIMITATION OF LIABILITIES OF MY DIVINE TRIP

My Divine Trip does not control or operate any airline, coach, hotel, transport vehicles, restaurant, or any other facility or service mentioned in the Itinerary.

My Divine Trip shall not be responsible for any delay, improper service, or standard of service provided by any service provider or any Independent Contractor, or for any injury, death, loss, or damage caused by the act or default of any hotel, airline, coach owners, cab operators who are My Divine Trip independent contractors.

My Divine Trip shall not be responsible for any act or actions of co-travelers, or co- passengers which may result in injury, damage to the life or limb or property of the User, or which may lead to interference in enjoying or availing the services provided on the outbound tour.

My Divine Trip being merely a facilitator, shall not be liable for the following:

Personal injury, sickness, accident, death, loss, delay, discomfort, increased expenses, incidental, consequential loss and/or damage, or any kind of theft howsoever caused to the User or any person traveling with them.

Any act, omission, or default of any travel agent or third party or any other person or by any servant or agent employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility, or service for the User or any person traveling with him /her.

The temporary or permanent loss of, or damage to, baggage or personal belongings howsoever caused including willful negligence on the part of any person.

Any delay made in the delivery of the service by the concerned service providers.

Failure on the part of the airline to accommodate passengers despite having confirmed tickets for any reason whatsoever including overbooking, change of route, etc., or failure on the part of the hotel to allow check-in despite confirmed booking for whatever reason.

Any claims of any dispute with the tour manager.

Any claim arising due to delay at the airport and if the User has to wait at the airport or at the hotel for check-in due to any technical snag or any other reason not attributable to My Divine Trip, we shall not be liable for making any arrangements, including but not limited to food or any hotel arrangement in case of such delays.

Any damages caused to the User due to reasons beyond the control of My Divine Trip.

In no event shall the entire liability of My Divine Trip for any claims, directly and indirectly, arising out of the tour exceed the total booking amount paid by the User.

There can be exceptional circumstances where the service operators like the airlines, hotels, the respective transportation providers or concerns may be unable to honor the confirmed bookings due to various reasons like climatic conditions, labor unrest, insolvency, business exigencies, government decisions, operational and technical issues, route and flight cancellations, etc. If My Divine Trip is informed in advance of such situations where dishonor of bookings may happen, it will make its best efforts to provide a similar alternative to its User or refund the booking amount after reasonable service charges, if supported and refunded by that respective service operators. The User agrees that My Divine Trip being an agent for facilitating the booking services shall not be responsible for any such circumstances and the customers have to contact that service provider directly for any further resolutions and refunds. The maximum liability of My Divine Trip in such events will be to refund the booking amount subject to receipt from the service providers.

AIRLINE:

The airfares the Company has contracted with various airlines are non-refundable. The Company shall in no circumstances whatsoever be liable to the Client or any person traveling with him/her for:

  • While all efforts would be made to accommodate members of a family traveling together on the same flight, depending upon the overall group size the company reserves the right to split the group into multiple airlines for any departure
  • Loss of baggage/ loss of life or loss of other valuables by the airlines
  • Overbooking of seats by the airline
  • Failure on the part of the airline to accommodate passengers despite having confirmed tickets
  • Change of flight timings or change of route with or without prior intimation

If the flight is overbooked or canceled for whatever reason and the client is not allowed/able to board the flight, the client shall not hold the Company responsible for the same and no claim whatsoever can be made by the client. All incidental expenses arising out of such a situation will be payable by the Client

Please note that low-cost airlines do not provide meals onboard

There is a limitation on how much luggage can be carried as check-in baggage and cabin (hand) baggage. Luggage carried over and above the limit will have the be paid for by the Client at the time of check-in. Please note for a few sectors carrying cabin baggage is not allowed

Airport taxes /airport development fees as applicable to be paid over & above tour cost should there be a rise post the printing of the brochure

Though chances are less, however depending upon the group size the company reserves the right to split the group into multiple airlines for any departure.

HOTEL:

We have mentioned the indicative names of the Hotels for each tour. We reserve the right to change the same due to unavoidable circumstances. In that case, we may provide alternative, similar accommodation for which we are not liable to pay any refund. We will not be responsible or liable in case of loss of property or life at the Hotel. Similarly, any damages caused to the hotel rooms during your stay shall be payable by the Clients and the Company will not be liable for the same

MEAL:

The menus are preset and provided for breakfast/lunch/dinner on the tour as mentioned under each Tour itinerary. The meals will be served either at restaurants of hotel of stay or the same could be arranged at local restaurants.

We cannot process a special meal nor do we guarantee the special diet to the customer. We however reserve the right to change the meal arrangement if circumstances make it necessary to do so.

If a tour participant does not avail his/her meal in the stipulated time, he/she has to avail the meal on his/her own arrangement and expenses. No claim can be made for the meal that he/she has missed and unutilized

TRANSPORT/CAB:

The usual vehicle used is Air Conditioned Sedan (Etios/Dzire etc) for 2-4 pax; SUV/MUV (Innova/Ertiga etc) for 4-6 Pax or Tempo Traveller for 7-10 pax

Transfers as per itinerary only for the mentioned Sightseeing

A/C in the Vehicle will be switched off during hilly drives.

Please consult the driver / local representative for the next day's sightseeing schedule / Transfers timings.

If you are carrying any high-value items on the coach, we advise you not to leave them behind when you leave the coach. We will not be responsible or liable in case of theft or robbery of the said items from the coach. All baggage and personal effects are at all times and under all circumstances your responsibility

The drivers of the vehicles are bound by specific rules like maximum driving hours within a day. Clients will have to strictly adhere to the prescribed timetable for the day so that the driver can complete the travel. In case, any of the sightseeing schedules are missed due to delays caused by the client, flight delays, unforeseen traffic, etc.. the same will not be refunded to the client under any circumstances.

SCOPE OF ACTIVITY:

We are travel and holiday organizers only. We do not control or operate any airline, nor do we own or control any shipping company, coach or coach company, Hotel, Transport, or any other facility or service mentioned in this brochure. We take care in selecting all the ingredients in your holiday; but because we only select and inspect them and have no control over running of them, we cannot be responsible for mechanical fault or any injury, death, loss, or damage that is caused by the act or default of the management or employees of any hoteliers, airlines, shipping company, coach owner/ Transport operator who are the company’s independent contractors arising outside our normal selection and inspection process.

HEALTH & SAFETY:

The Company shall in no circumstances whatsoever be liable to the Client or any person traveling for:

  • Any death personal injury, sickness, accident, loss, delay, discomfort, increased expenses, consequential loss and/or damage, or any misadventure howsoever caused
  • Any act, omission, default or Independent Contractor or other person or be any servant or agent, employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facilities, or service for the Client or for any a person traveling with him however caused
  • The temporary or permanent loss of or damage to baggage or personal effects howsoever caused In this condition the expression “Howsoever caused” includes negligence on the part of any person

No liability on the part of the Company arising in any way out of this Contract in respect of any tour, holiday, or excursion facility shall exceed the total amount paid or agreed to be paid for the tour holiday, and shall in no case include any consequential loss or additional expense whatsoever If the Client has any complaint in respect of the services provided by any of the Independent Contractors, the Client shall immediately notify the same in writing to the Independent Contractor and a copy thereof should be handed over to us to enable the Company to take up the matter with the Independent Contractor so that in future other Clients do not face the same difficulty

Any claim or complaint by the Client must be notified to the Company in writing within 2 weeks of the end of this holiday tour. No claim notified to this Company beyond this period will be entertained and the Company shall incur no liability whatsoever in respect thereof Each of these conditions shall be severable from the other end if any provision is invalid, illegal, or unenforceable. The remaining provisions shall nevertheless have full force and effect

FORCE MAJEURE:

In these booking conditions, 'force majeure' means any event in which My Divine Trip / the supplier of the service(s) in question, foresee or avoids, even with all due care. Such events may include disruptions/diversions of air services, floods, earthquakes, riots, civil strife, terrorist activity, industrial disputes, natural disasters, adverse weather conditions, disease outbreaks, fire, and all similar events outside the control of the party concerned.

We cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our agreement with you is prevented or affected by, or you otherwise suffer any damage or loss due to, 'force majeure'.

GUEST RESPONSIBILITIES:

While some of the pointers require Self-awareness. Some are strictly prohibited.

Take a Little Consent before taking pictures of people & their materials;

Respect things local including Drivers, Guides, and Staff. Pls. Do not misbehave or manhandle.

Do Not Be loud during any part of the journey. If anything is not up to the mark, please inform the helpline number and check with a local representative

Maintain Cleanliness. Please use dustbins or take back the day's litter to your hotel’s bin.

Do not Drink or Smoke in Public Places;

Do check with crew/representatives before taking away things from Flights, Hotels, and Cabs. Usually, Toiletries (soap/shampoo/moisturizers/comb/dental kit/ loofah/slipper) are free takeaways in Hotels if they are placed in small pouches for one person's consumption.

Do not enter restricted areas or off-road where you please. Pls. consult.

Proper permits are required to take videos or film;

Do not dirty & damage vehicles, hotels; property; place; habitats & vegetation

Cancellation & Refund Policy

CANCELATION POLICY:

  • All flight packages are a combination of three components, 1. Flight Tickets, 2. Balaji Darshan Pass & 3. Hotel, Cab & Others, cancellation charges are different for each of these and it is as per below stated for each.
  • Flight Ticket: Cancellation policy is as per the airlines on your ticket, in general, the cancellation charges are between ₹ 3000 to ₹ 3700 per person per route depending on the airlines.
  • Balaji Darshan Pass: If a darshan pass is taken, 100% of the darshan pass cost is non-refundable and it is non-transferable the cost of the tickets can be seen on the AP Tourism Darshan Tickets.
    (The price of the darshan pass is under the sole discretion of AP Tourism)
  • Hotel, Cab & Others: Cancellation charges will be on the cost excluding flight ticket & darshan pass price.
  • Cancellation charges per person
  • Before 30 Days of departure: 20%
  • 30 Days to 15 Days before departure: 40%
  • 14 Days to 7 Days before departure: 60%
  • 6 Days to 0 Days before departure or No Show: 100%

REFUND POLICY:

Refunds (If any) for amendments and/or cancellations will be paid directly to the Client by way of Demand draft/Crossed cheque/ Cash/Online Transfer at the discretion of the Company. It would at least take between 2 to 4 weeks to process refunds, subject to My Divine Trip receiving the amount from the said service providers.

There is no refund payable for any unutilized services (e.g. Meals, Entrance Fees, Optional Tours, Hotels, and Sightseeing, etc.) for any reason whatsoever.

In case the User makes any changes in their accommodation while on the Tour, My Divine Trip shall not refund or pay compensation in any manner whatsoever.

Privacy Policy:

INTRODUCTION:

This Privacy Policy describes how My Divine Trip and its affiliates (collectively "My Divine Trip, we, our, us") collect, use, share, protect, or otherwise process your information/personal data through our website swastikhandlooms.com (hereinafter referred to as Platform). Please note that you may be able to browse certain sections of the Platform without registering with us. We do not offer any product /service under this Platform outside India and your personal data will primarily be stored and processed in India. By visiting this Platform, providing your information, or availing of any product/service offered on the Platform, you expressly agree to be bound by the terms and conditions of this Privacy Policy, the Terms of Use, and the applicable service/product terms and conditions, and agree to be governed by the laws of India including but not limited to the laws applicable to data protection and privacy. If you do not agree please do not use or access our Platform.

COLLECTION:

We may track your behavior, preferences, and other information that you choose to provide on our Platform. This information is compiled and analyzed on an aggregated basis. We will also collect your information related to your transactions on Platform and such third-party business partner platforms. When such a third-party business partner collects your personal data directly from you, you will be governed by their privacy policies. We shall not be responsible for the third-party business partner’s privacy practices or the content of their privacy policies, and we request you read their privacy policies prior to disclosing any information. If you receive an email, or a call from a person/association claiming to be My Divine Trip seeking any personal data like debit/credit card PIN, net banking or mobile banking password, we request you never provide such information. USAGE:

We use personal data to provide the services you request. To the extent we use your personal data to market to you, we will provide you the ability to opt out of such uses. We use your personal data to assist sellers and business partners in handling and fulfilling orders; enhancing customer experience; resolving disputes; troubleshooting problems; informing you about online and offline offers, products, services, and updates; customizing your experience; detect and protecting us against error, fraud and other criminal activity; enforce our terms and conditions; conduct marketing research, analysis and surveys; and as otherwise described to you at the time of collection of information. By using the Platform, the users accept the security implications of data transmission over the internet and the World Wide Web which cannot always be guaranteed as completely secure, and therefore, there would always remain certain inherent risks regarding the use of the Platform. Users are responsible for ensuring the protection of login and password records for their accounts.

DATA DELETION & RETENTION:

You have an option to delete your account by visiting your profile and settings on our Platform, this action would result in you losing all information related to your account. You may also write to us at the contact information provided below to assist you with these requests. We may In the event of any pending grievance, claims, pending shipments, or any other services we may refuse or delay the deletion of the account. Once the account is deleted, you will lose access to the account. We retain your personal data information for a period no longer than is required for the purpose for which it was collected or as required under any applicable law. However, we may retain data related to you if we believe it may be necessary to prevent fraud or future abuse or for other legitimate purposes. We may continue to retain your data in anonymized form for analytical and research purposes.

CONSENT:
